Question 1

Can my landlord keep my deposit for cleaning?

Accepted Answer

Often only if the unit was left dirtier than when you moved in, beyond normal use. Rules vary by state.

Question 2

Can I use my deposit as my last month’s rent?

Accepted Answer

Usually not without the landlord’s written agreement. Doing so can lead to deductions or an eviction case.

Question 3

How long does a landlord have to return a security deposit?

Accepted Answer

It depends on your state, often 14 to 30 days after you move out, sometimes longer. Some states require an itemized list of deductions within that time.

What counts as normal wear and tear?

Accepted Answer

The natural aging of a home from everyday living: faded paint, minor scuffs, small nail holes, worn carpet. Holes in walls, broken fixtures or pet damage usually aren’t.

Question 5

Can a landlord charge for repainting?

Accepted Answer

Usually only if you damaged the walls beyond normal use, or after a long time if your state allows. Normal fading generally isn’t chargeable.

Accepted Answer

In many states, missing the deadline or not itemizing can mean the landlord must return the full deposit, sometimes with a penalty.

State your move-out date, the amount, your forwarding address, your state’s deadline rule, and a date to pay. Attach photos and keep a copy.

Accepted Answer
